These terms and conditions (the “Terms”) describe the terms and conditions that apply to the purchase, acceptance, and use of the Lafleur gift cards (collectively “Lafleur Cards”). The Terms govern your purchase and use of Lafleur Cards. By purchasing or using a Lafleur Card, you agree to be bound by these Terms. Please take the time to read these Terms carefully and make sure that you understand them before purchasing or using your Lafleur Card.
In these Terms, “Lafleur”, “we,” “us,” or “our” refer to and encompass LES RESTAURANTS LAFLEUR INC., with offices located at 3970, de Mont-Royal Street, Longueuil (Québec) J4T 2H5, and participating Lafleur restaurants and their respective predecessors, successors, assigns, parents, subsidiaries, affiliates, sister companies and each of their respective officers, directors, shareholders, employees, and agents; and "you" or "your," refer to you, the Lafleur Card holder.
For clarity, Les Restaurants Lafleur Inc. is only involved in the issuance of Lafleur Cards and the administration of the Lafleur Cards program. Les Restaurants Lafleur Inc. does not own or operate all Lafleur restaurants. Certain Lafleur restaurants may be owned by independent franchisees and operated as independent businesses. Each such restaurant is solely and independently responsible for any issues relating to the sale of products to you.
Purchase. Lafleur Cards can be either physical or electronic. The Lafleur Cards may be purchased at participating Lafleur restaurants, online at www.restolafleur.com, on the Lafleur App, and at other authorized retailers or on their websites. Lafleur Cards purchased through authorized retailers may be subject to additional terms and conditions as set forth by such third parties. Lafleur Card purchases are final and non-refundable.
Currency. Each Lafleur Card is denominated in Canadian Dollars, irrespective of the currency used to purchase it.
Use. Lafleur does not charge any fees in connection with the use of Lafleur Cards. Each Lafleur Card is usable up to its balance and only to purchase products, including meals, at participating Lafleur restaurants or online at www.restolafleur.com. Online orders are subject to additional order terms available at https://ueat.io/en/terms-and-conditions. Lafleur Cards cannot be used for online orders placed through third party online ordering services.
The Lafleur Card must be presented at the time of order to purchase products. The Lafleur Card must be in good condition. To find out if a particular Lafleur restaurant is a participating restaurant, ask the applicable Lafleur restaurant, look on the Lafleur App or call ahead to confirm it is a participating restaurant prior to placing your order. Lafleur cannot guarantee acceptance of your Lafleur Card at all Lafleur restaurants because certain Lafleur restaurants may operate as independent franchises.
Expiration. The Lafleur Card prepaid dollar value balance never expires.
Card Balance. You can check the balance on a Lafleur Card at participating Lafleur restaurants or online with the Lafleur Card balance checker at https://restolafleur.checkyourcardbalance.com , or through the Lafleur App. The Lafleur Card is not redeemable for cash. However, if the balance on your Lafleur Card is $5.00 or less, you may request from a participating Lafleur restaurant to have the balance refunded and paid to you in cash.
Reloading Lafleur Cards. You can reload the dollar value of a Lafleur Card in several ways. Lafleur Cards may be reloaded at participating Lafleur restaurants, and may also be reloaded online at https://restolafleur.myloyaltyhub.com or on the Lafleur app using a credit card. Lafleur Cards do not have to be registered in order to reload them at Lafleur restaurants, but they must be registered in order to be reloaded online at https://restolafleur.myloyaltyhub.com or on the Lafleur app.
The maximum dollar value that can be associated with any one Lafleur Card at any given time is [$500.00]. On any calendar day, the sum of your Lafleur Card’s starting balance and all amounts you load that day cannot exceed [$500]. No single individual may purchase Lafleur Cards with a total value of more than [$2,000.00] per order and/or [$10,000.00] on any calendar day.
Restrictions. A Lafleur Card may not be used to buy additional Lafleur Cards and is not returnable or redeemable for cash except as required by law and as set forth below. The Lafleur Card is not a credit or debit card, and no credit card, overdraft protection, deposit account, or depository insurance is associated with it.
Only a single Lafleur Card can be used for each transaction. The balance on a Lafleur Card cannot be transferred to another Lafleur Card. Lafleur Cards may not be sold, exchanged or used for any other purpose, except as specified in these Terms, without our written permission.
Unauthorized Use. You agree not to purchase, use, transfer or tamper with a Lafleur Card in any manner that is harmful to Lafleur or its customers. We reserves the right without notice to refuse to accept or otherwise limit the use of any Lafleur Card and to take further action if you do so or if you engage in prohibited activities in connection with your Lafleur Card. Prohibited activities include if you : sell or exchange a Lafleur Card for cash, purchase a Lafleur Card from an unauthorized third party, use a Lafleur Card as payment for a business purpose (e.g. pay employees or clients), tamper with a Lafleur Card, copy Lafleur Card(s) numbers, including redemption numbers and activation and PIN codes, without purchase, remove Lafleur Cards from a restaurant without purchase or use a Lafleur Card for any illegal or unauthorized purpose.
Lost or Stolen Lafleur Cards. Lafleur is not liable for lost, damaged or stolen Lafleur Cards. Lafleur will not replace or refund any Lafleur Card that has been lost, damaged, or stolen.
Privacy. Our privacy policy (available at https://www.restolafleur.com/legal/privacy-policy) will govern our use of personal data collected through the Lafleur Card program. We may use the contact information which you provide when purchasing your Lafleur Card for the purposes of notifying you of various offers, specials, product or other promotional information from time to time. If you do not wish to receive any such promotional information you may opt-out of receiving any such communication.
Liability and Disclaimers. Except to the extent prohibited by applicable law, Lafleur Cards are provided on an "as is" and “as available” basis without any conditions, representations, or warranties of any kind whatsoever, whether expressed, implied, statutory, or otherwise. Lafleur does not warrant or represent that your Lafleur Card will always be accepted at participating Lafleur restaurants. Except to the extent prohibited by applicable law, in no event will Lafleur have any liability or responsibility for any amount or kind of loss or damage that may result to or be incurred by you or a third party, arising out of or in connection with your purchase or use of a Lafleur Card; except that, in the event that a Lafleur Card is non-functional, your sole remedy and Lafleur’s sole liability, shall be the replacement of such card.
Inability to Perform. Lafleur will not be liable to you or to any third party for any delay or other failure to perform under these Terms that is due to causes beyond our control or the control of third-party fulfillment providers, including without limitation acts of God, acts or omissions of third parties, telecommunications failures, technical issues, network or system malfunctions or other force majeure events.
Amendment of these Terms and Termination. Except as otherwise expressly prohibited or limited by applicable laws, we reserve the right to modify and update these Terms, including Lafleur Card acquisition rules, rules relating to the use and restrictions of your Lafleur Card, card balance redemption options, our privacy policy and our use of your personal information, terms and conditions relating to our liability and exclusion of warranties, and the governing law and conflict resolution provisions, at any time, for any reason. Before we modify or update these Terms, we will send you a written notice 30 days before the modification or update comes into force. The notice will be sent to the email address you provided at the time of purchase of the Lafleur Card. The notice will set forth the new clause, or the amended clause, and the clause as it or they read formerly, and the date of the coming into force of the amendment. Should the amendment or update result in a reduction of our obligations, you may refuse the amendment and present yourself at a participating Lafleur Restaurant prior to the expiry of the aforementioned 30-day period in order to have the balance of your Lafleur Card refunded and paid to you in cash. Any such changes will be posted at www.restolafleur.com/legal/lafleur-cards-terms-conditions.
Governing Law and Jurisdiction. The laws of the Province of Quebec, and the federal laws of Canada applicable therein, shall apply to these Terms and the purchase and/or use of your Lafleur Card, without regard to principles of conflict of laws. Any claims, controversies, or disputes related to or arising from these Terms and the purchase and/or use of your Lafleur Card will be settled before the courts of the Province of Quebec, judicial district of Montreal.
Miscellaneous. These Terms (together with the documents referred to in them) represent the entire agreement between you and Lafleur in relation to your purchase and/or use of your Lafleur Card. These Terms are between you and Lafleur and may not be enforced by any other person. These Terms are available in the French language at www.restolafleur.com/fr/legal/conditions-générales-cartes-lafleur. In case of any inconsistency between the English and French version of these Terms, the French version will govern.
